Cosby jury ends first day of deliberations without a verdict

The judge in Bill Cosby’s sexual assault trial instructed jurors to break for the evening on Monday, after four hours of deliberations. “He says she didn’t say yes”, county District Attorney Kevin Steele argued Monday.Jurors did hear Cosby’s side of the story – but not in his voice. But jurors still heard plenty from him as prosecutors read them excerpts from his 2005 police statement and civil deposition.He is accused of drugging and attacking Constand, now 44, at his Pennsylvania home.Each of the three counts carries a standard sentence range of 5 to 10 years in prison, but that doesn’t mean Cosby could be facing up to 30 years. Constand did make a brief call to Cosby at 9:45 p.m. March 16, 2004, he said.The prosecution rested its case on Friday after calling 12 witnesses to the stand. He also described three pillars of the case had been proven: 1) Cosby drugged Constand; 2) She was “legally” unconscious; and 3) She was unable to consent to sexual activity.”Put them down, they’re your friends”.Cosby testified over a decade ago as part of that lawsuit, eventually settling with her for an undisclosed sum.”You ingratiated yourself into this woman’s life”, he said.” ‘She’d remember it for the next 365 days and all the days of her life if there were a sexual assault in this case, ‘ the attorney said”. By allowing Cosby’s wife to enter the courtroom in the middle of proceedings while the judge was speaking, officials at the Montgomery Courthouse extended her an extraordinary and unprecedented courtesy.Cosby’s attorneys sought to portray her as a woman whose allegations were motivated by money.Constand testified that the assault left her humiliated by someone she had thought of as a friend and mentor.Defense attorney Brian McMonagle told the jury that Cosby and Constand were lovers who had enjoyed secret “romantic interludes” and that the 2004 encounter was consensual.As he described reaching into Constand’s trousers, Cosby testified, “I go into the area that is somewhere between permission and rejection”. In criminal trials, the onus is on prosecutors to prove guilt beyond a reasonable doubt, and defendants are not required to take the stand.The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.The lawyer grew especially excited when he displayed a statement from Constand that the night of the alleged assault, she called Cosby from the street to tell him she was at his home and ask to be let into the driveway. She testified that nothing romantic happened in the hotel room, and that she made those phone calls as part of her job at Temple.McMonagle, pounding the defense table, suggested to jurors that Cosby was the victim of a drumbeat of accusations by women who wanted to appear on television shows.The defense could call other witnesses to try to bolster their argument that Cosby had a consensual relationship with Constand, 35 years his junior.Prosecutors say his prior use of Quaaludes shows that Cosby had knowledge of what he was doing when he gave her the pills. Mr Steele said Mr Cosby, a Temple University trustee and the university’s most famous alumnus, set his sights on Ms Constand, an employee in the university’s athletic department who was 36 years younger than him.Cosby has been accused of sexual misconduct by over 50 women, but he has always maintained his innocence.Steele reminded the jury that Constand reported that she had double vision and “rubbery” legs after taking the pills Cosby gave her – and woke with her clothing half off.With Cosby’s wife of 53 years, Camille, looked on from the gallery for the first time in the 6-day-old trial, Cosby told a judge that he made the decision not to testify after talking it over with his lawyers.Cosby has previously arrived at the Montgomery County Courthouse with various celebrities from the world of entertainment.As jury deliberations continued on Tuesday, Cosby’s spokesman, Andrew Wyatt, released a statement from a woman, Marguerite Jackson, who was barred from testifying as a defense witness.Other actors have joined on other trial days, including two appearances by Joe Torry.
